Protect Yourself Don’t Let Guest Bloggers Upload their own Images
by Daniel Snyder on Nov 30, 2010 • 9:13 pm 33 CommentsAre Guest Bloggers flocking to post on your popular blog? Guest Blogging is an excellent way to add posts to your blog and expand your reader base. I’m not going to get into all the details of why you should be a guest blogger, and why you should publish guest posts – there are enough articles about that available (take a look for yourself!) π
Instead I wanted to offer a word of caution and advice. You must protect yourself and your blog, and DO NOT allow guest bloggers to add their own images to their submissions. While I’m at it, if you are a blogger you need to be aware of the potential consequences of using copyrighted images on your blog.
Protect Yourself: Don’t Let Guest Bloggers Upload Their Own Images
Reason #1 You never know where guest bloggers got their image.
A lot of bloggers don’t do anything more than a google image search and grab the first picture that catches their eye. I know, I’m guilty of doing this (in the past!). The bad news is that the image is definitely owned by someone (though they may not have registered their copyright).
Fish & Associates in California was asked “Can the owner of a copyrighted picture sue a blog for using it without permission?” Their response (which technically is based around the laws of the state of California, but would likely be very similar everywhere else), states “Infringement is infringement. In general, if you have no permission to use the image, then such use is infringement. There is a “fair use” defense, but that very well may not apply. On the other hand, from a practical standpoint you might be able to keep using the image indefinitely. Although copyright attaches when an author reduces an original work to a tangible medium of expression, (i.e., paper, or computer image), the copyright owner cannot sue on that copyright until the copyright is registered with the copyright office. Generally, if the infringement commenced before the date of registration, the only remedies are are (1) injunctive relief (i.e., the infringer is told to stop) and (2) actual damages (which are probably very to prove). For such infringement, the really strong remedies of statutory damages and attorneys fees are not available.”
Admittedly I do think the likelihood of a lawsuit is exceptionally low, I wouldn’t personally want to risk putting myself in a situation where I could be confronted for using someones copyrighted image. Do the right thing. Finding images that are legal and free to use may require a bit more work than a simple google search, but ultimately you’ll find higher quality images and have a greater peace of mind.
Reason #2 You need to have control over the flow and visual appearance of your blog
Your blog needs to flow, and be visually appealing. You are the designer of your blog, as such you should have total control over its content. In the same way you wouldn’t publish an inferior quality blog post, you can’t just publish any image. If you’re investing time in quality written content, you should also be paying close attention to the visual quality of your content. Namely, the images you are using. Do they catch the eye? Are they well placed, and do they flow with the rest of your blog?
High Quality Royalty Free LEGAL images for your blog
The best resource I’ve found on the web for quality royalty free images is freedigitalphotos.net. For the vast majority of their images you simply insert a link crediting the author at the bottom of your article. There are options to purchase the image at a higher resolution with no need to link back, but for the majority of bloggers web sized images are perfect for blog posts, and a link back is not a big deal at all. Perhaps you can tell your guest bloggers that if they want to pick their own image this is the resource you’ll accept images from.
If you’re wanting more information on the copyright laws surrounding images you can read this post on eHow.

So protect yourself and tell your potential guest bloggers that you’ll be supplying the image for the post. They should be able to understand this. If they do want to supply an image, make sure you check the source, and verfiy whether or not the owner of the image needs a link back. Ultimately your readers, and your guest bloggers will thank you!

I don’t currently accept guest posts in my blog, but if I would, I’d ask for the source of the image, to verify it’s under CC or similar license.
Besides, if the image is really not indicated for the post/blog, I’d have a say in the matter for sure.

Gabriele, why aren’t you accepting guest posts? Just curious.

I think I explained it wrong.
It’s not like I don’t accept them, just that I don’t have a policy up for them.
I never thought people would be interested to guest post in such a young blog, but surely if anyone shows interest, I wouldn’t say no.

I have wondered about guest bloggers and images. I never thought about such points, and they really make sense. I don’t get many guest bloggers, but if I do I’ll keep these tips in mind.

I’m a huge fan of the site you linked and that’s where I got all my royalty free images for our first guest blogger contest. I think all bloggers should read this articel if they allow guest posting. The fines can be huge and well I know I can’t afford it!

Hey Dan,
I can’t really say that I’m getting tons of guest blogs (only one as of now LOL), but I totally agree with your advices. If you want to be certain that something will be done right, it is better to do it yourself. Same thing applies with images, as they can make a big difference on the way people look at a blog post. You might as well get into some legal trouble like you’ve mentioned if the author has taken the first image, he got his hands on after a Google search. I’m currently using Flickr to supply my blog with images and I’m pleased with it. Of course first making sure that the images are under the creative commons licence.
Thanks for the useful advices! Have a nice day mate! π

Daniel – hey I’d be very happy to guest post on your blog should you be interested. Let’s chat! As I’d also be interested in having your write an article here… maybe we can do an exchange? let me know.

Hi Daniel,
As a guest poster, I prefer control over the look and feel of my post as much as possible, and I have uploaded images.
As a blog owner I would insist on that same control.
Yes, I want it both ways. That’s only fair, right? π

Rick, you said it well. I agree for sure. With the guest posts I’ve submitted I’ve been in most cases unable to submit images and the blog owners wanted the option to choose the pic. In most cases I’ve been happy with what they picked… but hey, it’s their blog, they are giving me a special privilege just to post there, so I’m grateful whether I choose the image or not! Thanks for your comment.

Hi Daniel
There are advantages to being technically challenged lol
When I guest posted on Rick’s site I asked him to choose the image. I so couldn’t have found the one he did. And from his comment above, glad I asked him π
I always worry about copyright so will check out the site you have recommended. Up until now I have always got my niece to photograph images so mine have all been my own. Now I have to sort myself will be looking for quality images.
Thanks so much for this post. Really helpful information Daniel. Much appreciated.

Patricia, I think the bloggers who take the time to create their own images deserve extra credit! Taking photos, or designing something takes extra time – but can be worth it, you’ve got some totally original content there if you created it yourself, and no one else has that pic! (yet… maybe they might steal it from you) π I’d encourage you to keep creating your own if you can make time!

I was thinking about the similar matter the whole day today.
Why? Because I was reading a great blog yesterday and I was wondering about their images. I contacted the owner and am still waiting for response.
I asked him if it is OK to use the images he used (because I like them and I want to use similar stuff).
Maybe you can tell me?
For example, can you use an image of, let’s say, a cartoon character (Simpsons, Garfield, Disney, or any other) without any credits and links?
I completely agree with what you are saying here because on my first website (pet related) I always had trouble finding nice pics that won’t get me in trouble π
Daniel Snyder says:

Brankica, I would suspect that any of those characters you mentioned are fully copyrighted and the rights to their images are owned by their creators. But I’m not a copyright expert. The odds are you could use them without ever being caught, but I wouldn’t personally encourage or recommend it. I think it is wise to find sites like the one I mentioned in the post, or peruse Flickr and find people who give permission for you to use their images!

Truth be told it is all too easy to just type some img tags in HTML editor and pull in an external image, blocking uploads doesn’t reduce the risk of images being put into posts.
There are plugins you can install that only search and allow uploads of copyright free images, and offering one of these to your guest bloggers can help them choose a royalty free image. Freebie Images is a plugin that isn’t so bad.
Daniel Snyder says:
Dec 2, 2010
Of course you are right Justin, and I’m not implying that blocking uploads is the solution. Ultimate the blog owner is the one who hits publish – so all I’m saying is make sure you are the one responsible for the images you’re putting on your blog. If a guest blogger included an image (whether by uploading or through html), then I would encourage the blog owner to remove it and replace with their own… unless otherwise discussed of course.

It is funny you mention this because I just had my third guest post published at Famousbloggers where a commenter complimented the pic associated to the post, but I quickly had to let him know that this was inserted by Hesham the blog owner.
And I am actually glad he chooses the pics because it saves me the trouble plus the pic he chose fits well and is extremely cool π

Don’t let your guest bloggers upload their own images – they may be copyrighted! You need to know where the pictures on your blog come from….

I don’t know why people would let their readers upload images anyway – I can’t imagine that it would ever really bring anything to the table. If an image is essential, they should link to the image instead. Too many bloggers get hung up on adding all this functionality which actually brings no value. Instead it usually ends up hurting them, by slowing down their blog and ruining their design as you mentioned above.
Excellent post

Thanks for your comments Dave. You bring up a good point – being sure your images are optimized for the web, so that load time is reasonable… something ALL bloggers should make a point of doing!

This is exactly the reason why I don’t add my images to my guest post. I make the blog owner do it ;)). When I use an image from the internet, I add the website URL at the bottom of the post. I hope that might solve all issues. I think I will continue with my “no adding images to Guest posts” campaign. I don’t want to get in any trouble. Moreover the blog owners tend to find better images. Anyway, Thanks for the article, Daniel !

It is true. Though, not all actually mind of seeing their pictures around the net, finding the right place where you could get the videos is the most ethical way for your blogging. You canβt just disregard that fact.

I did think of this when I issued by guest post policy. They must provide proof of copyright. Now it is matter of how to keep track of that proof.
